Welcome to PadelTuber (“we”, “us”, “our”). These Terms form a binding agreement between you and PadelTuber when you access our courses, community, coaching, or affiliate program (together, the “Services”), whether via Podia (our platform provider) or our website.
By enrolling, accessing, or using any part of the Services, you agree to these Terms.
Platform notice: PadelTuber uses Podia to host content, manage accounts, and process payments. Your use of Podia is also governed by Podia’s Terms of Service and Privacy Policy. Where there’s a conflict about platform operations (checkout, billing infrastructure, hosting), Podia’s terms control; for everything about PadelTuber’s content, rules, and offers, these Terms control.

1) Who we are & how to contact us
PadelTuber — training, community, and coaching to help padel players build a YouTube-centred personal brand.

2) Acceptance & eligibility
• You must be 16+ to use the Services.
• If you buy on behalf of an organisation, you confirm you have authority to bind it to these Terms.
• If you don’t agree, do not access or use the Services.

3) Accounts & community conduct
• Keep your login secure; you’re responsible for all activity under your account.
• Be respectful. No harassment, hate, illegal content, spam, scraping, or attempts to bypass access controls.
• We may moderate, remove content, or suspend access for breaches.

4) Our content & your licence
• All PadelTuber materials (videos, scripts, text lessons, templates, downloads, methods, logos, and designs) are protected by copyright and other IP rights and remain our exclusive property.
• We grant you a personal, non-transferable, non-commercial licence to use the materials for your own channel and learning.
• You may not copy, resell, redistribute, re-publish, teach, or package our materials as your own, nor share downloads outside your account.
“PadelTuber” and associated marks are our trademarks. Do not use them without written permission.

5) Your content
If you post in the community or submit materials (“User Content”), you:
• Grant us a worldwide, non-exclusive licence to host, display, and moderate your User Content in the Services;
• Promise you own the rights to it and it doesn’t infringe others’ rights;
• Understand we may remove content that breaches these Terms.

6) Subscriptions, trials, cancellations, refunds
• Plans: Bandeja, Vibora, Smash (features vary by plan).
• Free trial: 3 days where shown. You’ll be charged automatically at the end of the trial unless you cancel before it ends.
• Billing: recurring (monthly/yearly) via Podia/Stripe/PayPal.
• Cancel anytime from your account; access continues until the end of the paid period.
• Refunds: we do not offer prorated refunds for partial periods. If a refund is ever granted at our discretion, access may be revoked immediately.
(Platform billing, taxes, and invoices are handled by Podia/Stripe under their terms.)

7) Upgrades & plan changes
• You can purchase a different plan at any time (e.g., moving from Bandeja → Vibora or Smash).
• Because plans are separate products, a new charge applies at checkout. We may (but don’t guarantee) goodwill credits or discounts on request for mid-cycle moves.

8) Affiliate Program (Vibora & Smash)
If your plan includes affiliate access:
Eligibility & signup
• Must hold an active eligible plan and provide a valid PayPal email for payouts.
• We may approve, pause, or terminate affiliate accounts at our discretion.
Commission & payouts
• 50% commission on paid monthly, quarterly, or yearly subscriptions started via your unique link.
• Commissions are paid on the 28th of each month to your PayPal for cleared transactions (after any trial, refund, or chargeback windows).
• No minimum payout threshold. Small balances are paid monthly provided funds have cleared.
• If a payment is refunded/charged back, the commission is reversed or deducted from future payouts.
Promotion rules
• Be honest and compliant with advertising laws and platform rules.
• No spam, cookie-stuffing, impersonation, or misleading claims.
• Do not run paid ads against our brand terms without written permission.
• You may not misrepresent results or guarantee earnings.
• We discourage using YouTube Promotions to pump non-targeted traffic; it harms CTR/retention and can reduce channel performance.
We may update affiliate rules; material changes will be posted in your dashboard or emailed.

9) Coaching (Smash)
• Monthly 1-on-1 call included. You’ll get a booking link and a pre-call questionnaire/template to focus the session.
• Rescheduling: please reschedule 24h+ in advance. No-shows or late cancellations may be forfeited.
• Scope: strategy feedback, creative/editorial guidance, sponsorship approach, process improvements. This is educational guidance, not legal, medical, or financial advice.

10) Third-party tools & links
We reference or link to tools (e.g., CapCut, IrfanView, OverlayOn, Canva, Epidemic Sound, Fiverr, YouTube, Instagram, LinkedIn).
Use them at your discretion and under their terms. We’re not responsible for third-party services.

11) Disclaimers
• Results vary. We don’t guarantee monetization, sponsorships, views, or earnings.
• Services are provided “as is” and “as available.” We don’t warrant uninterrupted, error-free operation. Platform maintenance/outages may occur.

12) Limitation of liability
To the maximum extent permitted by law:
• We are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or goodwill.
• Our total aggregate liability for any claim is limited to the fees you paid to us in the 3 months before the event giving rise to liability.
Nothing limits liability for fraud, death, or personal injury caused by negligence where such limitation is unlawful.

13) Privacy & data
• We process your data to deliver the Services and run the community/affiliate program.
• Hosting, checkout, and storage are provided by Podia (our data processor).

14) Termination
We may suspend or terminate access for violations of these Terms or unlawful activity. You may cancel at any time from your account (see §6).

15) Governing law & venue
These Terms are governed by UK law. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
(If you mainly trade in Scotland/Northern Ireland, tell me and I’ll adjust the venue clause.)

We may update these Terms periodically. Material changes will be posted in-product or emailed. Continued use after updates means you accept the new Terms.
